US Court Gives Cairn Energy till Oct 20 to Respond to India’s Plea

Cairn Energy must file by October 20 its response to India’s Plea that the UK firm’s original petition for enforcement of a $1.2 billion arbitration award be dismissed, a US court has ordered.

In February, Cairn had approached the District of Columbia court to confirm the arbitration award it had won against India in a retrospective tax case, in response, India had pleaded before the court in August to stay and to dismiss Cairn’s petition.

“Petitioners (Cairn) shall file their response to respondent’s motion to stay no later than September 10, 2021; respondent (India) shall file its reply in support of its motion to stay no later than October 1, 2021; petitioners shall file their response to respondent’s motion to dismiss no later than October 20, 2021; and respondent shall file its reply in support of its motion to dismiss no later than December 20, 2021,” Judge Richard J. Leon directed on Wednesday.

Last December, an arbitration tribunal ruled in favor of Cairn Energy in a six-year-old retrospective tax dispute and ordered the Indian government to pay the UK firm damages of $1.2 billion plus interest and cost. S-ET
